General Terms and Conditions No. 1

1.1. These General Terms and Conditions of Use apply to the website www.aquajet.pt, owned by the limited company Aquajet, Equipamentos Nauticos Lda, a legal entity under Portuguese law registered at the Commercial Registry Office under no. 507136870, with a share capital of EUR 5,000.00 (five thousand euros) and registered office at Rua Prior António Alves Nogueira, 4740-376 Fão | Esposende.

1.2. Before accepting these General Conditions, the user must read them carefully and in full. If you have any questions, you can obtain clarification by sending a registered letter to the above address or, if you prefer, by email to geral@motofaozense.pt.

1.3. All requests for clarification, complaints, suggestions, or other communications regarding the use of the website should be sent to Aquajet, Equipamentos Nauticos Lda by one of the means indicated in the previous paragraph, and will be reviewed and responded to in the same manner within five (5) business days.

General Conditions No. 2

2.1. The services provided by Aquajet, Equipamentos Nauticos Lda to the user shall be governed by these General Conditions and applicable legislation.

2.2. The user shall express their willingness to adhere to these General Conditions by registering on the website www.aquajet.pt.

2.3. Registration as a user provides the user with access to the services provided by Motofãozense-comércio De Motores De Explosão Lda, under the terms of the General Conditions of Use below.

2.4. The registration mentioned in the previous paragraph shall be carried out by entering the user's identification data and other distinctive information in the appropriate fields on the website, as well as by selecting the option to understand and accept, without reservation, the content of these General Conditions.

2.5. The provision of the services made available by Aquajet, Equipamentos Nauticos Lda depends, in each session of use, on the insertion, in the appropriate fields of the website, of the “username” and “password” chosen by the user at the time of registration.

2.6. The User must keep the aforementioned “username” and “password” secret and, if they suspect or are aware of any misuse of such data by third parties, they must notify Aquajet, Equipamentos Nauticos Lda, so that they can be changed.

2.7. Aquajet, Equipamentos Nauticos Lda is authorized, when required for security reasons, to rename all or any elements of user accounts, namely the username and password, notifying users thereof, as well as to cancel accounts that have been inactive for more than six months or that are being used in violation of these General Conditions.

2.8. Aquajet, Equipamentos Nauticos Lda reserves the right to unilaterally change these General Terms and Conditions of Use, in which case the user must expressly accept the changes made if they wish to continue using the services provided.

General Terms and Conditions No. 3

3.1. The object of Aquajet, Equipamentos Nauticos Lda covers the electronic commerce of goods and services, including the services made available and/or promoted through its website.

3.2. The prices of goods sold by Aquajet, Equipamentos Nauticos Lda are expressed in euros (EUR) and include VAT at the legal rate in force. The prices are listed in the appropriate section of the website, along with the payment methods available to the user.

3.3. Aquajet, Equipamentos Nauticos Lda reserves the right to change prices, shipping costs, or other amounts indicated, as well as photos, product descriptions, and their nature, without prior notice.

a) In the event of a computer error, whether manual or automatic, or of any other origin, which causes a substantial change not foreseen by Aquajet, Equipamentos Nauticos Lda in relation to the retail price, such that it becomes manifestly derisory or exorbitant, the purchase order will always be considered invalid and consequently canceled.

b) Aquajet, Equipamentos Nauticos Lda will only inform users with orders in progress whose items/orders are subject to the aforementioned changes.

3.4. The images displayed on the website www.aquajet.pt are merely representative and may not fully correspond to the product presented. This does not exempt you from carefully reading the respective description (product/item).

3.5. All items/products sold by Aquajet, Equipamentos Nauticos Lda are covered by transport insurance from Aquajet, Equipamentos Nauticos Lda to the customer.

3.6. Aquajet, Equipamentos Nauticos Lda informs that under national law, the legal framework, designated as “customer,” has a period of 14 consecutive days to withdraw from the contract (purchase).

a) Before returning the item(s), you must contact Aquajet, Equipamentos Nauticos Lda in writing (by email or registered letter) to inform them of your intention.

b) The order must be sent to Aquajet, Equipamentos Nauticos Lda or to whomever we designate for this purpose, with the user bearing the shipping costs. Under no circumstances may charges be imposed on Aquajet, Equipamentos Nauticos Lda.

c) This item(s)/product(s) must be in the same condition as when delivered (sold) and will be checked by our company for verification purposes.

d) Returns of items/products that do not comply with the above provisions, situations previously informed by Aquajet, Equipamentos Nauticos Lda, and products in tamper-proof packaging (blister type) will not be accepted.

General Conditions No. 4

4.1. The user may, at any time and without justification, cancel their registration on the website by sending a letter to the address indicated in G.C. No. 1.1. or, if they prefer, by sending an email to geral@motofaozense.pt.

4.2. If the former user wishes to register again on the website, they must mention this in the field provided for additional information, with a view to reactivating their old account. In any case, they may, if they so wish, create a new account.

General Conditions No. 5

5.1. The personal data provided by the user when registering on the website will be organized electronically in a database belonging to Aquajet, Equipamentos Nauticos Lda, for the sole and exclusive purpose of its use in contractual relations between Aquajet, Equipamentos Nauticos Lda and the user.

5.2. The data referred to in the previous paragraph may be used in the promotion of other services of Aquajet, Equipamentos Nauticos Lda, unless the user objects, in which case they may request its removal at any time.

5.3. If the user does not expressly state, when registering on the website, their opposition to the processing of data for the promotion of other services provided by Aquajet, Equipamentos Nauticos Lda, their silence will be considered as acceptance.

5.4. The user is responsible for the information transmitted about them to Aquajet, Equipamentos Nauticos Lda when registering on the website and, under penalty of criminal proceedings, the respective identification data and other personal details must be reliable and permanently updated.

5.5. Aquajet, Equipamentos Nauticos Lda assumes no responsibility for the possible registration of users by third parties, whether authorized or not, as well as for any subsequent uses, whatever they may be.

5.6. All anomalous situations will be investigated after being reported or brought to the attention of Aquajet, Equipamentos Nauticos Lda, and, in case of doubt, reported to the Public Prosecutor's Office for the opening of a criminal investigation.

5.7. The user or third parties acting under the identity of the user or a fictitious person shall be liable to Aquajet, Equipamentos Nauticos Lda and third parties for any damages caused to them by the inaccuracy or falsity of the registration data, or by failure to comply with the obligation to keep them up to date.

5.8. Aquajet, Equipamentos Nauticos Lda undertakes to the user to comply fully with the legal rules relating to the protection of personal data.

5.9. Under the terms of the applicable legislation, the user has the right to access, rectify, update, and remove their personal data, either directly on the website or by sending a letter to the address indicated in G.C. no. 1, paragraph 1.1.

General Conditions No. 6

6.1. These General Conditions and all rights and obligations arising therefrom or from any contract entered into under them shall be governed by and subject to the laws of the Portuguese Republic and other provisions of international conventions to which Portugal is a party.

6.2. Unless otherwise provided by law, the District Court of Porto shall have exclusive jurisdiction to settle all disputes arising from the interpretation or execution of these General Conditions or any contract entered into under them, with express waiver of any other.

6.3. In addition, and in accordance with European Directive (EU) No. 524/2013 of the European Parliament and of the Council of May 21, 2013, on online dispute resolution for consumer disputes (ODR Regulation), the legal framework, referred to as “customer,” has the option of resorting to ODR (Online Dispute Resolution) where it can communicate and submit any complaint it deems relevant. However, we warn that Aquajet, Equipamentos Nauticos Lda is not a member, so any dispute will have to be mitigated through the provisions of our G.C. No. 6, paragraph 6.2.

General Conditions No. 7

7.1. The website www.aquajet.pt is protected by European copyright laws, and all its contents are the property of Aquajet, Equipamentos Nauticos Lda or third parties with whom we have authorization to use their images or content. Use by third parties is strictly prohibited and may be subject to criminal prosecution.

7.2. The catalogs available on the website www.aquajet.pt are the sole responsibility of their authors. Their use and download are protected by the property rights of their authors. Aquajet, Equipamentos Nauticos Lda only makes them available and is not responsible for any incorrect or improper use by third parties. These catalogs may be in a language other than Portuguese, and Aquajet, Equipamentos Nauticos Lda cannot be held responsible for this situation.
